How to Approach Someone Important - The Muse How to Approach Someone Important You’re sitting in a cafe minding your own business, when suddenly you notice that the person you’ve wanted to have as a mentor or boss is sitting at a nearby table. This could be your big moment to make a good impression, or you could totally fall flat on your face in awkwardness. So what do you do? This scenario was a question that a reader in New York emailed me. And if you’ve had moments like this, too, you have three options. Two of them are ones that you’re probably already weighing. The third is a bit unexpected- but could put you much closer to a seat at that table in the future. 1. Do Nothing Let’s get this out of the way now. Yes, doing nothing is an option. But if you’re really serious about your career, it’s a terrible option. Don’t waste chances. Of course, if you’re not feeling up to it (because of nerves, not feeling that you’re dressed appropriately, or some other reason), that’s understandable. It might not be the right time for your target, either, especially if there are any cues in the person’s demeanor that show intense focus or discomfort. But don’t let the opportunity pass you by. Also don’t send an email saying “I saw you earlier and didn’t say anything,” because that’s creepy. Just proceed to option #3. 2. Approach If the person is not engaged in a conversation or looking visibly upset, wait for an idle moment, then step up and try this script: Hi [use the formal Mr./Ms. and the person’s last name]. Do you have a moment? [If the answer is “no,” say “thank you” and move on. If the answer is “yes,” continue.] I just wanted to come over and introduce myself. My name is [your name] and I’ve really enjoyed your work, especially [something recently in the news]. I’m [a bit about you and your background], and if you ever have some time, I’d love to hear more about your work and career path. What I’m recommending here is an approach grounded in flattery, brevity, and respect for others’ time. You don’t want to immediately go into “pitch” mode and risk sounding like you’re selling used cars. An informational interview is low-intensity for both parties and, as long as you’re prepared, can get you started on developing a meaningful connection. Of course, this person can respond to your approach by rejecting you (hopefully politely like, “No, thank you” or “I’m not interested”). You could also get the green light that you’re looking for and walk away with another opportunity! Take the chance. 3. “The Pretzel” No, this is not some seductive dance step. It’s a tactic I learned at my company, Bureau Blank, about taking a “roundabout” path with networking. Rather than engaging the target person directly, hop over to LinkedIn and see if one or more people in your network are more closely connected to him or her. If so? Reach out and ask for an introduction or endorsement. I received a pretzel (if I can put it that way) recently when a grad school colleague contacted me on behalf of a person who is interested in learning more about Bureau Blank. He spoke highly of her background and said these key words: “I think you’ll be impressed by her.” Who in your network can say that about you? Identify them and ask for the favor because you’ll get much closer to the opportunity. Think of it this way: You could write a letter to President Obama yourself, but if you could get someone in the Cabinet to endorse you, why wouldn’t you? The key to all of these options is thinking first, then acting with judgment. Think about what will make connecting with you a meaningful effort for the person you want to meet. Once you know, be bold and step up. Chances don’t come around twice, so have a plan and be ready for whatever comes. How the CSI Effect Influences American Jurors How the CSI Effect Influences American Jurors The CSI effect is a belief held primarily among law enforcement personnel and prosecutors that forensic science television dramas, such as CSI: Crime Scene Investigation, influence American jurors to expect more forensic evidence to convict defendants of crimes. Public Perceptions of Forensic Science In forensic science television dramas, crime scene investigators collect and analyze evidence, interview suspects and solve the crime in one hour. Police and prosecutors know this is unrealistic, but they are concerned that the futuristic technology and speedy resolutions viewers see each week shape the public’s expectations of crime solvers. Television writers and producers do not make their characters live within the time and funding constraints placed on actual forensic scientists. Professionals worry that jurors may acquit guilty defendants because forensic evidence is not presented by the prosecution at trial. Since the television shows gained popularity in the early 2000’s, juries have been on pins and needles when it comes to forensic evidence. Talking about science in the courtroom used to be like talking about geometry - a real jury turnoff. Now that theres this almost obsession with the (TV) shows, you can talk to jurors about (scientific evidence) and just see from the looks on their faces that they find it fascinating,” Jury consultant Robert Hirschhorn said in a 2004 USA Today story. Empirical Research on the CSI Effect The CSI effect has not been substantiated by empirical research. “While some existing evidence on juror decisionmaking is consistent with the CSI effect, it is equally plausible that watching CSI has the opposite impact on jurors and increases their tendency to convict,” Tom Tyler said in the Yale Law Review in 2006. There are instances documented in news stories where jurors specifically request forensic evidence. Even if these instances can be attributed to the CSI effect, they themselves  do not empirically prove a widespread phenomenon. Stories like these compel prosecutors to outline to juries why certain pieces of evidence do or do not exist in a case. For example, jurors in a murder case may expect to hear ballistics evidence if the murder was committed using a firearm. If the bullets were damaged so that they could not be conclusively matched to the alleged murder weapon, a prosecutor would explain this rather than omitting the ballistics report from the state’s evidence list. Gregg Barak, Young Kim and Donald Shelton conducted research on the opinions of potential jurors in Ann Arbor, Michigan. In the summer of 2006, they set out to find whether those people who watched programs like CSI demanded to see more scientific evidence before they would convict a defendant. “Although CSI viewers had higher expectations for scientific evidence than non-CSI viewers, these expectations had little, if any, bearing on the respondents propensity to convict. This, we believe, is an important finding and seemingly very good news for our Nations criminal justice system: that is, differences in expectations about evidence did not translate into important differences in the willingness to convict,” Shelton wrote about the research for the National Institute of Justice in March 2008. Shelton said they saw more of a “tech effect” where jurors are influenced by advances in technology rather than what they watch on television. As jurors see technological advances in their own lives, they expect forensic science technology to keep up with or outpace consumer technology. Impact on Forensic Science Education Since the rise in popularity of forensic science television dramas, the number of universities offering forensic science degrees has increased as have the number of students pursuing those degrees.

How Long HR Must Keep Employee Files How Long HR Must Keep Employee Files One of the big things about Human Resources is that we have tons of paperwork. Tons and tons and tons. Granted, a lot of it is electronic these days, but the principle remains. HR does record keeping. And, we need to keep those records, but for how long? Here are basic guidelines for HR record keeping. Remember, though, that state laws may vary from these guidelines. If state laws and Federal laws conflict, always keep the records based on whichever requirement is longer. It is better to keep something for too long than not long enough. Hiring Records You need to save all of those resumes, interview notes, applications, and job postings, and even a record of your searches through your applicant tracking system for one year after the decision to make a job offer was made. So, if you interview an applicant, and the whole process drags on for three months, its not until the  final hiring decision is made  that the clock starts ticking. Why do you have to do this? If anyone ever questions your hiring decision, you will need to show that you were  not discriminating illegally in any way, shape, or form. Laws such as the  Americans with Disabilities Act,  Title VII, and many others  require you to demonstrate youre in compliance. Maintaining these records helps you do this. Drug Test Records If  you require drug testing for pre-employment, its part of the hiring record, and you should keep a copy of the results for one year. If you do additional drug testing, whether due to an incident at work or as part of a random check, you also need to maintain these records for one year. However, if you are subject to Department of Transportation regulations, then the minimum time frame for drug test records is five years. Payroll/Timecards, Etc. The law requires you to maintain these records for three years, but recent lawsuits mean it would be smarter for you to keep them for longer. You want to maintain a record of how much each employee was paid, and how many hours they worked for their entire tenure at your company. Keep your records for at least five years after the employee leaves, regardless of reason. For exempt employees, of course, you dont need to maintain time records, as their pay is the same regardless of the number of hours worked. However, if you ever misclassified an employee as exempt when she should have been non-exempt, these hours worked records can guide you for paying owed overtime. Make sure that you include how the company  calculated  pay. For instance, you need to track whether it was straight salary, salary plus commission, overtime, piecework, or straight hourly pay. You need to do this not only for pay and tax questions but many other decisions rely on the number of hours worked. For instance, eligibility for FMLA is dependent on the number of hours worked in a year. If you have a part-time exempt employee, you might want to consider requiring time recording to determine FMLA eligibility. You also need to be able to prove that you paid your workers for all of the hours they worked. Form I-9 Maintain the employee I-9 Form, stored separately from your personnel records, for three years after you hire the employee and for one year following employment termination, whichever is later.   Health/Pension Benefits Information You need to keep the records of your plans for all of your benefits for a minimum of six years. The courts have held that if an employee sues you, saying that he or she deserves a higher pension, for instance, its the employers responsibility to prove that they dont owe more, not the employees responsibility to prove that they do. Keep all of those Summary Plan Descriptions. If you have former employees who are eligible for COBRA, extending their health benefits, you should also keep those records for six years just to be safe. The law doesnt specify retention, but since this could apply under the Employee Retirement Income Security Act (ERISA), this law requires retention for six years. To be on the safe side, dont throw those records out. FMLA Records When an employee requests FMLA, you need to keep that paper trail, even if you deny the leave for three years. Make sure that you keep track of each employees leave - when it began and how much time is used. If the employee has intermittent FMLA, make sure you track every leave and document the number of hours used. Dates and the number of hours should be documented. Remember, intermittent leave can be used for a few hours in a day, or a few days in a week. Document it all and keep those records. Remember, this is not a comprehensive list and applies only to Federal statutes. You may be subject to additional record retention laws if, for instance, you are a Federal contractor or your state has different standards. When in doubt, dont throw it out.
